Terms of Service

Effective October 13, 2026. These terms are an agreement between you and Sweet Kandi ("Sugaree", "we", "us").

By using Sugaree you agree to these terms and to our Privacy Policy. If you use Sugaree for a brand or a business, you agree on its behalf and confirm you are allowed to.

1. Who can use Sugaree

You must be at least 18. Sugaree is currently by invitation. Keep your sign-in key private; you are responsible for what is done with it, and you must tell us at once if you think someone else has it.

2. What Sugaree is

Brands share licensed material in "Drops", with house rules for how it may be used. Creators make images and short videos from that material in the studio, refine them, and publish the ones they want to share. Every published piece carries an invisible watermark and signed content credentials, and a record of how it was made, so it can be traced back to the people who made it and they can be credited and paid.

3. Brand material

Brand material belongs to the brand. A brand grants you a limited, revocable permission to use its Drop's material inside Sugaree, to make pieces within its house rules, and to share pieces you publish as these terms allow. You may not download, extract or use brand material outside Sugaree. Brands confirm they have the rights to everything they put in a Drop.

4. What you make

You keep whatever rights you have in your own contributions to a piece, such as your prompts, your choices and your edits. The brand keeps all rights in its own material, including when it appears in your piece.

When you publish a piece made from a brand's Drop, you give that brand a non-exclusive, worldwide, royalty-free, perpetual license to use, copy, show, distribute and adapt the piece in its own marketing and advertising, in any medium, crediting you where practical. This is how pieces earn: brands use them, and earnings flow back through Sugaree's payment rules to the people who made them (see section 8). The brand may not claim to have made the piece, or remove its watermark or content credentials.

You keep whatever rights you have in your own contributions, such as your prompts and choices. AI-generated material may not be protected by copyright, and similar prompts can produce similar results, so we cannot promise any piece is unique or exclusively yours.

By publishing, you give Sugaree a worldwide, royalty-free license to host, show, copy, watermark, attach credentials to, and distribute the piece, to show its record of how it was made, to let others remix it where you allow remixing, and to use it to run, promote and improve the service. This license continues for copies already shared before you unpublish, and for the parts of the record that must be kept (see the Privacy Policy).

5. Rules for using Sugaree

You must not:

6. Checks, review and takedowns

Sugaree checks requests before anything is made, and may flag finished pieces for a person to review when they are published. A flagged piece may be held out of sight until a reviewer, from the brand or from Sugaree, looks at it. The brand, Sugaree, or you may unpublish a piece at any time; anyone may report one. These checks are automated opinions with people deciding; we do not promise they catch everything.

A piece that is unpublished or taken down earns no credit and no payment from then on, and its share goes the way our payment rules send a disqualified piece's share.

7. Posting to other platforms

You may share your published pieces, using Sugaree's Share and Download, or by linking your own accounts and posting from Sugaree. Sugaree posts only when you press Post, and only the watermarked piece. Each platform's own terms apply to what you post there. Where a platform lets apps label AI-made content, Sugaree labels it. You are responsible for disclosing promotion of a brand where the law or the platform requires it.

If a piece is taken down, Sugaree removes your posts of it where the platform allows apps to do so. Where it does not (currently Instagram and TikTok), you agree to remove them promptly when asked.

8. Payments

Payments to creators are not live yet. Before they are, we will publish here how and when creators are paid, who is eligible, and how taxes are handled, and tell signed-in users. Until then, nothing in Sugaree is a promise of payment.

9. Our service

We may change, pause or stop features, and we may suspend or close accounts that break these terms. You may stop using Sugaree at any time and ask us to delete your account.

10. Disclaimers

Sugaree is provided "as is". To the extent the law allows, we disclaim all warranties, including that the service will be uninterrupted or error-free, or that any piece is fit for a particular purpose or free of third-party claims.

11. Limits on liability

To the extent the law allows, Sugaree is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim is limited to the greater of what you paid us in the twelve months before the claim, or US$100.

12. Your responsibility

You agree to cover Sugaree's reasonable costs, including legal fees, from claims caused by your content, your posts, or your breach of these terms.

13. Disputes

These terms are governed by the laws of the State of Delaware, United States, and disputes go to the courts there, unless the law where you live gives you the right to bring a claim locally.

14. Changes

We may update these terms. If a change matters, we will update the date above and tell signed-in users before it takes effect. Using Sugaree after that means you accept the new terms.
